LazaiTrader Terms of Service

AGREEMENT TO TERMS​

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and LazaiTrader ("we," "us," or "our") governing your access to and use of the LazaiTrader platform, including the Telegram bot, smart contracts, and all related services (collectively, the "Service").

By accessing or using LazaiTrader, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. ELIGIBILITY​

1.1 Age Requirement​

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to use LazaiTrader.

You must have the legal capacity to enter into binding agreements in your jurisdiction.

1.3 Geographic Restrictions​

You represent and warrant that:

  • You are not located in, nor a citizen or resident of, any Restricted Jurisdiction (see RESTRICTED_JURISDICTIONS.md)
  • You are not on any sanctions list maintained by the United States, European Union, United Nations, or other applicable authorities
  • Your use of LazaiTrader complies with all applicable laws in your jurisdiction

1.4 Prohibited Users​

You may not use LazaiTrader if you:

  • Are located in or accessing the service from a Restricted Jurisdiction
  • Are subject to economic sanctions or trade restrictions
  • Have previously been banned from the platform
  • Intend to use the service for illegal purposes

2. DESCRIPTION OF SERVICE​

2.1 What LazaiTrader Provides​

LazaiTrader is an automated cryptocurrency trading platform that:

  • Allows users to deploy non-custodial Smart Contract Wallets
  • Executes automated trades based on user-configured parameters
  • Operates via Telegram bot interface
  • Interacts with whitelisted decentralized exchanges

2.2 Beta Status​

LazaiTrader is currently in BETA. This means:

  • The service is experimental and under development
  • Features may change, break, or be discontinued without notice
  • Uptime and availability are not guaranteed
  • You use the service at your own risk

2.3 What LazaiTrader Does NOT Provide​

LazaiTrader does NOT:

  • Take custody of user funds
  • Provide financial, investment, or tax advice
  • Guarantee any returns or profits
  • Offer refunds for trading losses
  • Provide insurance for deposited funds

3. USER ACCOUNTS AND WALLETS​

3.1 Account Creation​

To use LazaiTrader, you must:

  • Connect via the official Telegram bot
  • Register a valid Ethereum-compatible wallet address
  • Deploy a Smart Contract Wallet through the platform

3.2 Wallet Security​

You are solely responsible for:

  • Maintaining the security of your wallet and private keys
  • Keeping your Telegram account secure
  • All activity that occurs through your wallet or account
  • Any authorized or unauthorized access to your account

3.3 Account Recovery​

Due to the non-custodial nature of the service:

  • We cannot recover lost private keys
  • We cannot access your funds
  • We cannot reverse any transactions

If you lose access to your wallet, your funds may be permanently inaccessible.

4. USER RESPONSIBILITIES​

4.1 Lawful Use​

You agree to:

  • Use LazaiTrader only for lawful purposes
  • Comply with all applicable laws and regulations
  • Not use the service for money laundering, terrorism financing, or other illegal activities
  • Report any bugs or vulnerabilities through proper channels

4.2 Accurate Information​

You agree to:

  • Provide accurate wallet addresses
  • Not impersonate others or misrepresent your identity
  • Keep your account information current

4.3 Configuration Responsibility​

You are solely responsible for:

  • Setting appropriate trading parameters
  • Understanding the implications of your configuration
  • Monitoring your positions and trading activity
  • Managing your risk exposure

4.4 Prohibited Activities​

You agree NOT to:

  • Attempt to exploit, hack, or manipulate the platform
  • Interfere with other users' access to the service
  • Use bots, scripts, or automation beyond normal platform use
  • Attempt to reverse engineer or decompile the software
  • Circumvent geographic restrictions or access controls
  • Use the platform to manipulate markets
  • Engage in wash trading or other deceptive practices

5. TRADING​

5.1 Automated Trading​

By configuring automated trading:

  • You authorize LazaiTrader to execute trades on your behalf according to your settings
  • You understand trades will execute 24/7 based on market conditions
  • You accept that trades may result in losses
  • You acknowledge that you cannot cancel pending automated trades

5.2 Trade Execution​

You understand that:

  • Trades are executed on third-party DEXs
  • Execution prices may differ from displayed prices due to slippage
  • Network conditions may delay or prevent trade execution
  • Failed trades may still incur gas costs
  • We do not guarantee trade execution at any specific price

5.3 No Guarantees​

We make no guarantees regarding:

  • Profitability of any trading strategy
  • Accuracy of price data
  • Timeliness of trade execution
  • Availability of liquidity
  • Performance of the trading algorithms

6. FEES​

6.1 Platform Fees​

LazaiTrader may charge fees for certain services. Current fee structures will be communicated through the platform. Fees may change with notice.

6.2 Network Fees​

You are responsible for all blockchain transaction fees (gas costs) associated with:

  • Deploying your Smart Contract Wallet
  • Executing trades
  • Withdrawing funds
  • Any other on-chain transactions

6.3 Third-Party Fees​

DEXs and other third-party services may charge their own fees, which are outside our control.

7. INTELLECTUAL PROPERTY​

7.1 Our Property​

LazaiTrader and its contents, including but not limited to:

  • Software and code
  • Trademarks and logos
  • Documentation and guides
  • User interface designs

Are the property of LazaiTrader and protected by intellectual property laws.

7.2 Limited License​

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

7.3 Restrictions​

You may not:

  • Copy, modify, or distribute our software without permission
  • Use our trademarks without authorization
  • Remove any proprietary notices from our materials

8. PRIVACY AND DATA​

8.1 Data Collection​

Your use of LazaiTrader is subject to our Privacy Policy (see PRIVACY_POLICY.md), which describes how we collect, use, and protect your information.

8.2 Blockchain Data​

You acknowledge that blockchain transactions are:

  • Public and permanently recorded
  • Viewable by anyone
  • Not subject to deletion or modification

9. THIRD-PARTY SERVICES​

9.1 DEX Interactions​

LazaiTrader interacts with third-party decentralized exchanges. These DEXs:

  • Are not operated or controlled by LazaiTrader
  • Have their own terms of service and risks
  • May experience their own issues or vulnerabilities

9.2 No Endorsement​

Integration with third-party services does not constitute an endorsement. We are not responsible for third-party service availability, security, or performance.

9.3 Telegram​

The Service is accessed via Telegram. Your use of Telegram is subject to Telegram's own terms of service.

10. DISCLAIMERS​

10.1 "As Is" Basis​

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10.2 No Warranty​

WE DISCLAIM ALL WARRANTIES INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

10.3 Risk Acknowledgment​

YOU EXPRESSLY ACKNOWLEDGE THAT:

  • Cryptocurrency trading involves substantial risk of loss
  • You may lose all funds deposited
  • Past performance does not guarantee future results
  • The smart contracts are unaudited

11. LIMITATION OF LIABILITY​

11.1 No Liability for Losses​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAZAITRADER SHALL NOT BE LIABLE FOR:

  • Any trading losses
  • Lost profits or revenue
  • Lost funds or cryptocurrency
  • Data loss or corruption
  • Indirect, incidental, or consequential damages
  • Damages arising from third-party actions

11.2 Maximum Liability​

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF:

  • The fees you paid to LazaiTrader in the 12 months preceding the claim, or
  • One hundred US dollars ($100)

11.3 Essential Purpose​

THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12. INDEMNIFICATION​

You agree to indemnify, defend, and hold harmless LazaiTrader, its developers, operators, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws
  • Your trading activities
  • Any claims by third parties related to your use of the Service

13. DISPUTE RESOLUTION​

13.1 Informal Resolution​

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting LazaiTrader through official channels.

13.2 Governing Law​

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13.3 Waiver of Class Action​

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. TERMINATION​

14.1 By You​

You may stop using LazaiTrader at any time by:

  • Withdrawing all funds from your Smart Contract Wallet
  • Discontinuing use of the Telegram bot
  • Deactivating trading via the platform commands

14.2 By Us​

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Geographic restriction compliance
  • Technical or security reasons
  • Discontinuation of the Service

14.3 Effect of Termination​

Upon termination:

  • Your right to use the Service ends
  • You remain responsible for withdrawing your funds
  • All disclaimers and limitations of liability survive

15. MODIFICATIONS​

15.1 Changes to Terms​

We reserve the right to modify these Terms at any time. Changes will be communicated through:

  • Updates to this document
  • Announcements via the Telegram bot
  • Posts in official community channels

15.2 Acceptance of Changes​

Your continued use of LazaiTrader after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the Service.

15.3 Changes to Service​

We may modify, suspend, or discontinue any aspect of the Service at any time without liability.

16. GENERAL PROVISIONS​

16.1 Entire Agreement​

These Terms, together with the Disclaimer, Privacy Policy, and Restricted Jurisdictions documents, constitute the entire agreement between you and LazaiTrader.

16.2 Severability​

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver​

Failure to enforce any provision does not constitute a waiver of our rights.

16.4 Assignment​

You may not assign your rights under these Terms. We may assign our rights without restriction.

16.5 Force Majeure​

We are not liable for delays or failures due to causes beyond our reasonable control.

BY USING LAZAITRADER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
